Terms of Service

1. Service Description

Scrum Poker Online is an online planning poker tool that enables software development teams to estimate user stories and tasks collaboratively during sprint planning. The Service is developed and operated by Fahri Mert Gundogan, trading as infwrite. Contact: contact@scrumpokerplay.com. These Terms constitute the entire agreement between you and Fahri Mert Gundogan (infwrite) regarding your use of the Service and supersede all prior agreements.

2. Eligibility and Age Requirements

To use the Service, you must:

• Be at least 16 years of age. If you are under 16, you may not use the Service.
• Have the legal capacity to enter into a binding agreement in your jurisdiction.
• Not be prohibited from using the Service under applicable law.
• If you are using the Service on behalf of an organisation, you represent and warrant that you are authorised to bind that organisation to these Terms.

3. Accounts

• Account creation is optional. You may use the Service as a guest without registering.
• You must provide accurate, current, and complete information when creating an account.
• You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You must notify us immediately at contact@scrumpokerplay.com if you suspect unauthorised access to your account.
• You may delete your account at any time from the account settings. Account deletion is permanent.
• We reserve the right to suspend or terminate accounts that violate these Terms (see Section 10).

4. Free and Pro Plans

The Service offers a Free plan and a paid Pro plan. The Pro plan unlocks additional features as described on the pricing page.

• Billing: Pro plan payments are processed by Paddle, our Merchant of Record. Paddle is responsible for charging your payment method and remitting applicable taxes.
• Subscription: The Pro plan is available on a monthly or annual basis. Your subscription renews automatically at the end of each billing period.
• Cancellation: You may cancel your Pro subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period; you retain Pro access until then.
• Refunds: You may request a full refund within 14 days of your initial purchase or annual renewal. Refund requests must be submitted to contact@scrumpokerplay.com. After 14 days, no refunds are issued.
• Price changes: We may change Pro plan pricing with at least 30 days' notice to active subscribers before the change takes effect.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. The following conduct is strictly prohibited:

• Violating any applicable local, national, or international law or regulation.
• Transmitting content that is illegal, defamatory, obscene, harassing, threatening, or discriminatory.
• Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
• Attempting to gain unauthorised access to any part of the Service, another user's account, or any related systems or networks.
• Interfering with or disrupting the Service, servers, or networks connected to the Service.
• Sending automated requests (bots, scrapers, crawlers) that place excessive load on the Service's infrastructure.
• Using the Service to send spam or unsolicited communications.
• Reverse engineering, decompiling, or disassembling the Service.
• Removing or circumventing any copy protection or security mechanism of the Service.

6. User Content

You may submit content to the Service, including room names, task descriptions, and chat messages ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant us a limited, non-exclusive licence to process and display it solely to operate the Service. We do not claim ownership of your estimation data. Session User Content (votes, chat) is automatically deleted 1 hour after a room becomes empty and is never stored permanently.

7. Intellectual Property

The Service and its original content (excluding User Content), features, design, code, and branding are and remain the exclusive property of infwrite and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our express written consent. The name "Scrum Poker Online" and associated logos and marks are proprietary to infwrite.

8. Service Availability and Modifications

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not guarantee uninterrupted, error-free, or secure access to the Service.
• We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
• We will make reasonable efforts to notify users in advance of planned maintenance that causes significant downtime.
• We are not liable for any loss or damage arising from Service unavailability.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of the Service.
• Our total aggregate liability for any claims arising under or in connection with these Terms shall not exceed the greater of (a) the total amount you paid us in the 12 months preceding the claim, or (b) USD $10.
• Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the minimum extent permitted by law.
• Nothing in these Terms limits liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot be excluded by law.

10. Termination

• You may stop using the Service and delete your account at any time.
• We may suspend or permanently terminate your access to the Service at our discretion, with or without notice, if you violate these Terms or engage in conduct we determine is harmful to other users or the Service.
• Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 7, 9, 11, 12, and 13) shall survive.
• If we terminate your account without cause, we will refund any unused portion of a prepaid Pro subscription on a pro-rata basis.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

12. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, pandemic, government action, internet or infrastructure outages, or actions of third-party service providers (including cloud hosting and payment processors).

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws applicable to infwrite's place of operation, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation by contacting us at contact@scrumpokerplay.com. If the dispute cannot be resolved informally within 30 days, it shall be submitted to the competent courts of the jurisdiction applicable to infwrite. Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief from a court of competent jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. For material changes, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be modified, it shall be severed. The remaining provisions shall continue in full force and effect.
